Legal Question in Family Law in California
Out of state visitation travel costs
I am a custodial parent of a three year old child. I was recently granted to relocate with child to another state, but not without a custody battle first. "Travel costs: 60% mother (custodial parent) 40% father". Father returned to court and was granted an order of court which redefined 40% father as childs airfare only. He did this without contacting me nor my attorney I had at that time. The father owes over 10,000 in child support and I am unemployed and having to fork out $400 a month and fly child to father in California. Can I return to court and ask for father to share in travel and costs 50/50? Would it be out of line to ask that the father do all the traveling with child and pay all costs until child support is current? I have an interest and calculation from the D.A.'s office and the proof of the money I have paid. Due to one to three weeks a month (summer) to be away no one will hire me for a full time nursing position. EDD will deny claims also I just receive notification. What are my options?

Re: Out of state visitation travel costs
If you are owed back child support, why not ask the court to apply your share of the travel costs against his back support? After all, if he paid support, you could afford to pay travel costs.
