Legal Question in Family Law in California
Statue of Limitations on Finalizing Divorce
My divorce was filed in May of 97 in the State of Calif. 2 years ago, we reached agreement on the divorce, but since my ex has not paid his attorney, no final papers have been filed. Is there some sort of Statue of Limitations to grant my divorce or null this marriage since we have not lived together since Dec of 96? Two years ago I moved from Calif to TN to put my life together but I live in limbo because I am not divorced or considered married. What is the best thing for me to do, so that I may move forward with my life?

If your spouse did not file, you can file in Tennesee if you proceed uncontested. I would check the status with your attorney in Calf. or check with the court.

you need to have someong review the court file, determine the current status of the divorce and complete it.

If you had an attorney, contact that person to push for a final decree. If you did not have an attorney, contact your husband's attorney or the court clerk for a status check. If the case is dismissed for failure to prosecute, you can start a divorce in Tennessee.
