Staying with a parent

My grandson is 6 years old.My daughter and x-husband get him every other weekend.My question is how old does a child have to be, before he can say if he wants to stay or not with his father? Every weekend we have to go though my grandson crying and saying he doesn't want to go. He say's he dad is mean and yell's all the time. This has been going on for a couple years. We make him go. The Dad just laughs about it he thinks it funny. I wonder, if this keeps up what effects this could have on him later in life. Or even now. There is no talking to the Dad. It seems like he doesn't care about his sons feeling. Is there any legal steps we can take. And alot of the time he will work and leave him with other people, and not spend time with him on his weekend. If he has plans for his weekend and he has some other place to go , he will call on Friday and say I can't take him, because I have plans. Thank you

This is a very difficult situation you should immediately conact an attorney regarding your situation. Obtainaing a counsleor to the the child will help him deal with the situation. Joint coundeling for the parents and the child will also hlep. It is also customary to give the other parent the right of first refusal if the parent the child is with cannot provide the needed care.
