Legal Question in Family Law in California

My step daughter has been living with us for about 2 months now, however the court order states mother is to have physical custody. The minor ran away from her mothers house and we agreed she could stay with us (with her mothers permission), if she could follow our rules. It is not working outand she wants to return to her mother, but her mother doesnt want her back. What is our legal standing? Can we just return her to her mothers house, her mother says she will call the police on us for abandonment? Again, court order states mother has physical custody, parents share legal custody.

You need to file court orders regarding current custody arrangements. You should contact the police to request what whether you may get in trouble for returning the child to her lawful parents home. Typically the order is the order of the court. Hopefully the mother will come to her senses and seek return of her child.

For self represented individuals you can consult with the family law facilitator self help center at your local court house.

As always please consult a local attorney prior to taking legal action. Good luck. Also please check out my Santa Clara County Family Lawyer blog.
