Legal Question in Family Law in California
Step parent custody rights
I have a 10 yr old step daughter (I hate the word step)who I have just recent lost custody of. I would like to know the most case law on step parent custody issues and my chances of ever getting my daughters back.

Re: Step parent custody rights
The law on custody gives preference to parents. A step parent has to show that custody of the child to a parent would be demetrimental to the child. A family code section provides that if a person has been providing for the physical and emotional needs of a child for a substantial period of time, that removing the children from this enviroment can be the requisite detriment.
