Does the new step parents income count ?

9 days ago I married a divorced man whose ex-wife is now stating that she will take us to court and have the child custody payments adjusted to include my income. He works full time and pays accordingly. She works on and off - depending on her mood. I have until tomorrow to turn in the marriage license with the county and may choose not to do so if she is eligible to gain from my employment, wages, personal savings, etc. etc.

California law provides that new spouse income is not to be used to determine child support. You will note that the computer program used to calculate child support. The sole purpose for including the new spouse income is to determine the amount of income tax that he pays. Often the new spouse income often results in a decrease of child support as the amount of taxes often increases.
