Step Parents Rights

My husband and I have custody of his 2 children from his first marriage. His ex-wife had no visitation rights for the first 1 1/2 years we've been together. She has recently sued us for visitation. During our mediation session she but up the fact that she didn't want me to spank the kids. My husband quickly disagreed. He said that I have been the only mother they've known for the last 1 1/2 years and said I have every right to spank them. I don't spank often, but I do spank when it is necessary. Do I have the legal right to spank them?

yes, unless there is a court order that says you cant.

California law a parent can spank with the open hand on the rear end. In some counties, such as Santa Clara county, corporal punishment of any kind is forbidden.
