Legal Question in Family Law in California

step-parent adoption

My husband would like to adopt my 12 year old daughter.

Her natural father commited suicide when she was 6 so my husband has been in her life since then. We were wondering how complicated it would be for him to adopt her and what are the benefits??

Re: step-parent adoption

it would not be complicated at all and would give him all the rights of a natural parent.

Re: step-parent adoption

You would have to file a petition for stepparent adoption, a copy of which goes to the county. It will then charge you a few hundred dollars for a background check, and if all is OK will approve it, then you set a court date and that's it. Your husband will have all the rights but also all the duties of a birthparent, including child support if you divorce, and your daughter will have all the rights of any child, including inheritance and rights to social security benefits as a survivor until she is an adult.

Re: step-parent adoption

This response is a supplement to the other two replies.

If your daughter is presently receiving survivor benefits from Social Security, those benefits would cease upon the adoption.

Re: step-parent adoption

Since the father is deceased you would not have to get any other consents than your own and your daughters since she is over12. Your husbanc may have to pay an investigation fee to the state based on a sliding scale.

You can do it yourself I can prepare all the paperwork for you to file the adoption yourself. email me for more information.

Re: step-parent adoption

Besides the legal ramifications of imputing all rights and duties upon your daughter and husband respectively, your daughter would have the psychological security of the commitment that you husband has made to her. Please call me directly at (619) 222-3504.
