Legal Question in Family Law in California

Step-parent adoption

I had my son at a young age. I do not know who the father is due to rape. My husband and I have been married for almost 5 years now. What do we need to do to have my husband adopt him in the state of California? How long does it usually take and how much (ballpark) does it cost? Is there any financial aid that we can use?

Re: Step-parent adoption

You need to file a stepparent adoption petition. Much of the work is easy and

you can do it yourself. I believe there is a book on adopting your stepchild.

You may have difficulty in terminating the rights of the unknown father. It is not

a difficult process for an attorney, but may be for a layperson.

The basic costs are a $19 filing fee, and an investigation fee which is a few hundred

dollars, but can be reduced or waived.

Through an attorney the cost is likely to be $1,500, more or less, plus the costs, although if

it goes smoothly it could be significantly less.
