Step-Parents rights

My husband has a 15 year old daughter whom has lived with us for the past 6 years. Her mother lives in another state. Her mother has not seen her in two years and maybe calls once a year. She does not pay child support, but there is no court order telling her to. My husband has just been sentenced to two years in prison. What are my rights as her step parent. Can her mom take her away? Is there anything I can do? She does not want to live with her mother. Can my husband sign guardianship to me?

You can try petitioning for guardianship, but her mother does have priority--perhaps she would agree to let her stay with you, or is unfit to take her in.
