Legal Question in Family Law in California

Stepson is on probation for assault and battery but also burglary. Father just left for military leave, and biological mother is now refusing to take custody of son. I have no legal rights to step son. What can and will the court do if mother refuses to take son, even though she had a verbal agreement with father on there joint physical custody.

He could become a ward of the court. You can file for guardianship so that you have custody of the child while dad is gone.
