Legal Question in Family Law in California

Stipulation Judgment

My soon to be ex and I have reached final agreement on all settlement issues. Opposing counsel wants to do a Stipulated Judgment. Is this the same as a Marital Settlement Agreement? If not, which is the better way to go?

Re: Stipulation Judgment

Stipulations and marital settlement agreements are not the same. The sitpulation is an agreement that the court should enter a specific order, the stipulation. A marital settlement agreement is just an agreement. Marital settlment agreements are often incorporated into and become part of the judgment. Other than some introductory information the major terms could be the same for both documents. There is no general rule that one is superior to the other. To determine which way to go in your situation is beyond the scope of an internet bulletin board.
