Stipulation of modificationof child custody

My ex husband mis represeted himself in having me sign a stipulation of modification of cild custody agreement. It was supposed to be temporary due to some medical problems i was having. He has since taken my son to live out of state. I have had primary custody for 5 years. My original court papers say an agreement between us must be signed and notarized. Or further order of the court. He submitted this to have the courts sign it. They did not know what the history was. He took my son from me 5-18-01 and refused to return him. I hav enot seen him since. My question? Is that stipulation valid without the notarized signature??? I have since filed for custody. I mediation today.
