Legal Question in Family Law in California

when and how to stop cp

my child turns 18 in feb..is there any paperwork that must be filed in order to stop payment of cp in feb or do we have to wait until june when the child graduates high school to stop cp..she does not attend ''full-time'' high school and has been working full time...wages are not garnished there is no case thru child supp enforcement and have never been behind in paying...cp was an amendment to original divorce order which had stated no parent pays cp b/c @ that time i (father) had both children from the marriage..minute order states until child is 18,legally emancipated, dies, marries or 19 and is full time high school student,or until further order of the court, whichever 1st occurs...so my ? is @ age 18(feb07)can i stop paying w/o filing any sort of paperwork?///would i be considered contempt of court?

Re: when and how to stop cp

Why don't you send her a note stating that February will be the last child support payment. Explain that support is stopping that because your daughter is 18 and not enrolled as a full time student in high school. This will give her notice that child support will stop and give her an opportunity to object to the stoppage of the child support.
