Legal Question in Family Law in California
Stop Divorce & Start Over Later
Hi,
I petitioned for divorce over a year ago. Husband never filed response. My separation date was 1-2-07. I would like to know how I could stop my divorce now and start over later when I have fewer liquid assets. I already bought hubby out on our condo and he signed a quitclaim deed, but now he's hired a lawyer and the whole divorce could start all over again. He wants some money he knows I have in savings during duration of marriage which I disclosed as community property; however, now savings are almost exhausted because I left him and had to pay all my own expenses. I have a lawyer but not happy with his services. Want to start over with divorce when I am poorer but want to retain my ownership of condo as it is now on my deed as ''my own sole & separate property''. What should I consider in this process of starting all over at a later date when I am cash/savings poor but still have my condo? BTW, I have custody of my one minor child who is 17.
Signed,

it might be a mistake to try to start over. the date of separation might be a big issue here. consult with another attorney before filing any more papers.
