Legal Question in Family Law in California

Can I stop my wife from taking our children to live in another country?

I am 33 years old, I got married when I was 24 to my girlfriend. I have two daughters one is 2.5 years the other is 9 weeks. We spent the last year and 3 months in China. We returned to the US and she gave birth, then wants a divorce, and in the divorce she wants to set the children's permanent residence to China.

Do you think the China request will fly? Will I loose physical visitations? I'll pay any child support to see my kids. She keeps saying I will be a webcam daddy.

The court will consider any reasonable request and since you lived in PRC for 15 months, do not underestimate the very real possibility that your soon-to-be ex-wife may succeed. Get a good family law attorney (preferably one familiar with China), but keep a close tab on legal fees, which can mount in a case like this quicker than you might realize.
