Legal Question in Family Law in California
stoppping child support payments
My x is still collecting support payments even though our oldest is no longr living with her. Our son just graduated from high school and i was recently told he is in Hawaii. My x never mentioned him leaving or his graduating. He is staying with her brother. She is still collecting child support for him too. How do I go about stopping child support payments. Now that both kids do not live with her can I request alimony stoped too. She works and now has no responsibility of either child and lives on her own. Plus her attorney had said he was going to take care of removing our daughter frm child support back when she turned 18 and he never did. She is 21 now, can I get back what was over paid. There is a wage assignment.
I had told work to stop taking out for my daughter but they daid they needed a new order is this true.

You can go back to court for an order modifying support, terminating support and alimony and seeking a refund.
