Legal Question in Family Law in California

Do I have to submit all physical evidence upfront or can I keep some until during the hearing, in a child custody case?

You do not need to exchange all the evidence right away, but if it is compelling evidence usually it's a good idea to present it earlier, so that it will increase the chances that your case might settle if the other party can assess that your evidence is strong and their evidence is weak. Unless it is impeachment evidence to show someone is lying or discredit them, then I usually like to exchange evidence early on so that it encourages settlement talks.

For self represented individuals you can consult with the family law facilitator self help center at your local court house.

As always please consult a local attorney prior to taking legal action. Good luck. Also please check out my Santa Clara County Family Lawyer blog.
