Legal Question in Family Law in California
I have submitted the divorce papers in April 2015 after no living with my spouse since April of 2012 had very Lil to no contact with him. We have 2 children he has not been there for them since 2012 so when. I filed for divorce I wanted total custody of my children since I have raised them ..my daughter dosnt know him at all she's almost 2 years old met him once when she was 5 months so obveously I find no point in him having rights when he don't use them and he dosnt pay child support. .I hired a lawyer to help with the process but has not been of much help all she did was file the divorce I keep trying to contact her to submit my deposition because the father of my children responded to the divorce papers, he agreed to the divorce except he wants joint custody, and that's just not fair because my children don't know him . Now after I recived his response he sent another request through the child support court saying he wants his child support reduced ?.. he has not paid anything in months and when he dose its not what was court ordered ..now my question is what is my next step ? don't I have some kind of advantage here because I'm raising my children alone and because he has done nothing for them ? I'm totally lost ?

The courts will facilitate any reasonable parenting plan as long as it is a safe and beneficial relationship for the children. Your ex may have a poor past track record but if he is sincere about developing a relationship with the children, now's the time to work on that plan.
