Legal Question in Family Law in California

When submitting a response to an order to show cause or notice of motion it�s suppose to be filed 9 business days before the court date. If the other party submits their response later than that, (4 business days) are you able to dismiss what they submitted? And if so, what happens if the case is continued. Does that mean that now the paperwork is submitted on time?

The court normally wants to hear these matters on the merits and will allow the other side the opportunity to present their opposition. Most family courts are fairly liberal in their application of of time requirements.
