Legal Question in Family Law in California

subpeona for bank records

My ex and I signed a stipulation that he would have custody of my five children, this was after I was awarded physical custody, because I could not continue to pay for an attorney and he would not stop taking me to court with frivolous nonsense. The stipulation included that I would get spousal support of !,000. per month and $500.00 per month for child support so I could afford to have the children with me. I finally got my SSI, something my ex new I was appealing at the time of the stipulation and specifically waived all child support. Now that my ex has found out that I receive SSI, he is bringing me back to court to pay him retroactive child support payments of $650. per month. He is now trying to subpeona bank records but I have someone else's name on my accounts since SSI is requiring that my account be controlled by an outside source. Can the ex get child support, even though he initially waived it? One more question, can he subpeona the bank records if someone else's name is on the account?

Re: subpeona for bank records

you should hire an attorney if you are seeking to prevent his subpoena of your bank records. Especially if a third party is a joint account holder that could help to block the account.

good luck.

As always consult a qualified attorney in your area before proceeding.
