Subpoena a witness: Is it better to only ask the business for production of documents, or bring the witness into the hearing? Do I need to let opposing council know of the subpoena that I send to a business (not consumer) for productions of records? I have a case where the defendant is concealing 1M worth of property, 3 are rental. Defendant hired a property management company to accept and process the renter's checks for him. The real estate broker has a trust account (BAC) for rental property owners to use. The agent keeps 6% of the rent as the property agent fee, and then wires the remainder to the Defendant's bank account. Defendant signed under oath that he has no property. (This is section 8 housing rental money rent too).
