Legal Question in Family Law in California
Subpoena's
I was wondering in California, if i could subpoena my son's teacher as a witness, if my son has told her stuff like...My ex punching holes in walls...etc? The principal of the school says the teacher cannot get involved. His teacher says she has no proof and therefore could not report to CPS or other sources. Please Let me know. Thanks

Re: Subpoena's
You can subpoena anyone you want as a witness. But it sounds like you are seeking hearsay testimony from the teacher -- the teacher needs to have witnessed such conduct, not just have been told about it by your son. The teacher would be a witness to what she has observed about your son, what she has observed/heard from the father. Separately, if the teacher saw bruises for example on your son and suspected child abuse, she would be required to report these observations to CPS.
