Legal Question in Family Law in California

Substitution of Lawyer

The paralegal of my divorce atty is always the one taking my call and I can't make an appt. with my lawyer for a legal advise. The paralegal said, I have no more fund available and she is being paid 100/hr. I do not know if all my e-mail or fax or any correspondence to my lawyer reaches his table. Now the problem, he sign an agreement that I was not informed, I want to clarify things. How can I change that signed agreement that I am not infavor, about the visitation order for my son.

I want to change to another lawyer, whom I can have an access for legal advises. Whats the procedure. Who will take all my papers from the other attorney. What is the chance that these new lawyer will not do the same.

Re: Substitution of Lawyer

Once you find a new attorney, the new attorney should draft a Substitution of Attorney that he/she will provide to the old attorney, and also request that your files be given to the new attorney. There is a chance the new attorney will do the same thing. Before you hire the new attorney, let the attorney know your concerns about being able to talk to him/her rather than the paralegal.
