Should I sue my husband?

In the past year or so, my husband was diagnosed with dementia and has had kidney problems. Now his kids want him and I recently found out that our marriage may not be legal because he may have still been married to his previous wife at the time. Also, his kids want conservatorship because he has approximately $50,000 in real estate and a banking account that they want. I was told that I may need to sue him to be compensated because if this is correct I have been off work because of his health and I will be put out of my apartment if he is given to his kids. What do I need to do to get this resolved? Do I need an attorney?
