can you sue the spose of a non custodial parent for child support

No. What duty do they have to the child? They were not responsible for the child being born. If you could sue then people paying child support could never remarry. In order to collect money from someone, they must have had a duty of some sort to you and breached that duty causing you to suffer injuries/damages.

A new spouse is not liable for his spouse's child support payments. You can take the non custodial parent to court, but not their spouse.
