The way you ask the question illustrates that you know nothing about the custody process and family law in general. Just for starters, you don't sue for custody and you don't plead causes of action. You need a lawyer. A parent seeking sole custody who does not know what they are doing can wind up losing custody, because a significant factor in a custody dispute is which parent is the most likely to foster frequent regular contact with the non-custodial parent and support continuation or development of a good parent/child relationship with the non-custodial parent. Going into court chasing sole custody if not done right and with good preparation of grounds and evidence will make you look like you are trying to interfere with the child's relationship with the other parent, and deny contact, all of which will make you look really bad when the court makes its decision on custody. Hire a local attorney.
