Legal Question in Family Law in California

What is a summary divorce and how long does it take...is it still 6 months from the time served to completion? Which state is more favorable to a woman getting a summary divorce: California or Oklahoma?

A summary divorce is right for those who have very little assets or debts and were married for very short periods of time. The timeframe for that is typically 6 months from the date of service on the respondent. As for what terms are favorable, most of the times in a summary divorce people just want to walk away. If you are seeking terms favorable to you like property division and spousal support then you might be better off going through a traditional divorce route and getting specific court orders addressing those issues for you.

For self represented individuals you can consult with the family law facilitator self help center at your local court house.

As always please consult a local attorney prior to taking legal action. Good luck. Also please check out my Santa Clara County Family Lawyer blog.
