Legal Question in Family Law in California
What is supervised visitation?
Hi. I am the custodial party of my 5 year old son. His mother has an admitted drug problem and becuase of this the court awarded us supervised visitation. These visits are supervised by the non custodial parent's mom and dad. I am wondering what exactly is supervised visitation? Do one of her parents have to be in the room with the mother and my son at all times? Thank you

Reply: What is supervised visitation?
Monitored visits means that the child is always with a third party adult, and the monitor also stops any inappropriate behavior or comments.
I suggest that you check with a professional monitoring service to find out the specifics of what a professional monitor does. Then let your monitor know what is expected.
Good luck to you.

Re: What is supervised visitation?
Supervision of the visits may depend upon the reason for the supervision. If it is drug usage, then being in the same room all of the time would not seem necessary, as long as the supervisor can be assured that the parent is not under the influence or taking drugs. Direct observation may not be necessary unless there have been occurrances of improper statements or actions during visitation. If you believe that the supervision is not adequate then bring a motion so that you may discuss the supervision with the judge. Be prepared to explain the problem and offer a solution to the judge.
