Legal Question in Family Law in California

SUpport includes pay for daycare, but child is not enrolled for last 3 years

Hello,

My Child support is broken down like this:

$300.00 Support

$50.00 for Insurance

$240.00 for my half of day care

Total of $590.00 per month

My Question is this, my child has NOT been in day care for over 3 years now, so do I still have to pay the day care portion??

You have to review the order of the court. Generally, 1/2 contribution for expenses are made payable only for long as the expenses are incurred.

You might be able to file a motion with the Family Court and ask for a refund of the almost $7500 you have paid in daycare expenses in the last 3 years based upon the fact the mother has not incurred the expense.
