Legal Question in Family Law in California

Support for non working spouse

I have been married less than two years and have been unable to work for five years, do to a health condition. My husband is my total financial support.

At this time I am applying for diability, as well.

Due to the short duration of our marriage ,would I be able to get support if we divorced?

Husband makes $80,000.00

Re: Support for non working spouse

You would likely receive temporary support based upon your husband's income. Temporary support lasts to the case cames to trial or you settle. It could be up to a year or so. In addition, the court has discretion to set permanant support after triaal for whatever time it wants. The short length of your marriage, however, is certainly an important factor.
