Legal Question in Family Law in California

Support for non-visiting child

There are 2 children from my 1st marriage. My 15 yr. old son lives with me and my 14 yr. old daughter lives with her mother. We have court ordered visitation and support. My son goes willingly to see his mom as scheduled. When time comes for my daughter to see me...she doesn't want to come and my ex-wife won't make her. I am curious; this has been ongoing for over two years and I'm tired of it. Can I terminate parental rights on this child??? If so, am I still responsible for child support???

If I were you I would go back to court and ask the judge to enforce the visitation order.

You can't terminate your parental rights without your ex-wife's consent, and you can't terminate support, either, unless your parental rights are terminated. Do you know why your daughter doesn't want to see you? Perhaps it makes sense to try and rectify the situation rather than giving up. I realize it's frustrating, but remember that she's a teenager, and those are difficult years. Perhaps speak to her school counselor about what you could do to put your relationship back on track....or seek the advice of a therapist who specializes in teenager issues. If you're on speaking terms with your ex, maybe she has some ideas....good luck.
