Legal Question in Family Law in California
Support Order Change of Venue
I have a 1995 support order in Santa Clara County. My children and I moved to LA County in 1997. The NCP still lives in North Calif. (not sure what county but I know it is not Santa Clara). I now want to modify the order. Must I first change the venue to LA County. How can this be done without having to actually appear in court in Santa Clara County -- I cannot take time off from work.

Re: Support Order Change of Venue
Sorry, but, you have to go back to the court that issued the order. That would be Santa Clara County. Then, you can file for a change of venue. It would be best to consult a local attorney to assist you. Good luck and thanks for inquiring.
Re: Support Order Change of Venue
Contact the local family support unit and request assistance in locating the ex and modifying the support order. This unit is often slow, due to a heavy case load. However, the new system is supposed to be faster in responding. There is no charge to you. If you hire an attorney you will have to pay the attorney, which you may or may not get back from the ex.

You can go back to Santa Clara County to modify the order or seek a change of venue. The change of venue will have to be heard in Santa Clara County so one way or the other you are back there!
I suggest that you consult with an experienced family law lawyer. Experience is not expensive, it's priceless!
