Legal Question in Family Law in California
Support after separation?
My husband has filed for divorce in Santa Clara County, saying that I pay all costs, that he pay me no support, and that I pay him support. We married 10/90, I had to move there, I moved back to Georgia in 11/2002, no children, nothing had been filed on record until now 10/2008. We filed taxes jointly thru tax year 2005. How does this affect spousal support? He makes $95-97,000/year and I now make $20,000, half of my salary in 1990. I am now 56, and want to regain my career, but need school. I supported us both while he got his Tech Writing certificate in 1991-92, which is his current occupation. He refuses to help more than a settlement of $35,000.
I have to respond to the suit before 11/17/08. What should I do?? Thanks.

Re: Support after separation?
You should file a response and request that he pay your attorney fees and spousal support. You have 30 days from the date of service in which to file a response.

You should retain counsel and file a response.
