Legal Question in Family Law in California

Support termination/modification

When my husband and I divorced, it was stated in the agreement that spousal support terminates upon my remarriage. As of the day I remarry, can he just stop paying or does he have to go through the court to terminate? Can my child support be raised based on losing the alimony? (I am unemployed, college student). I am currently being paid child/spousal support $1100 less that the dissomaster said I was entitled to.

Re: Support termination/modification

If the wording on the Judgement is that alimony shall terminate upon your re-marriage, then it terminates at that time, without further court orders. If based upon the loss of alimony, and increasing costs of living, etc., you feel that there are sufficient changes in your circumstances to warrant seeking a modification of child support, you are able to do so. A brief consultation with your attorney to punch up a new "disso-master" evaluation will indicate the advisability of that. pdm
