susceptability to being sued & subpeonas

i have 2 questions:

1. can a person be sued or charged in any way

by an ex-husband for sleeping with his

wife while they were legally separated?

2.what advice would you give to someone given a

subpeona to testify as a witness in a domestic violence case?

i'm not really sure what other information would be needed to answer

these questions.
