Legal Question in Family Law in California
Taking child out of state without Mother's consent or knowledge.
The paternal father of my son who had been residing with me and my other children here in Arizona left state with him without my consent or knowledge of his whereabouts. Neither one of us has court ordered custody. Is he aloud to do that? And if so how has he managed to sue me for child support when he doesn't have legal custody?

Re: Taking child out of state without Mother's consent or knowledge.
If there has been a Court order of Paternity (saying he is the Father), then it is not illegal for him to leave with the child. If there has never even been a Court order for Paternity, then he is basically kidapping the child.
Either way, it is important that you take immediate steps in Court to resolve this issue. The longer he stays gone without you taking steps, the stronger his case becomes.
