Legal Question in Family Law in California

Taking child out of State w/o permission

Can my daughter-in-law take my grandbaby (7mos old) out of state (California) to Connecticut without permission? She basically just packed up all the baby's things and moved out. They are legally married and there is no custody order of any kind as this was all a surprise to my son. They were married in Texas one year ago- the baby was born there. they have lived in California for 6 mos.

Re: Taking child out of State w/o permission

If there was no court order for custody and visitation she has the right to take the child with her to Connecticut. Your son should file a petition for dissolution of marriage and have her served. He could also file an OSC and request a temporary order that she return the child to California.
