Legal Question in Family Law in California

I am taking my seperated wife to court for a visitation modification & I am concerned about her new boyfriends influance on my son. Years ago he was convicted 3 times for felonies

(i think they were burgulary) & 1 of them was a serious felony' in 1995 he was convicted of possesion of Meth and was sentenced to 9 yers in prison. Since he has been with my ex he was arrested in March 2012 for DUI then 1 month later for drunk& disorderly, hes is now doing time for 1 of them & has been in jail for 30 days so far. Do I have a right to be concerned & is there something I can do about it in this action I am going to file?

You should ask in your motion that the boyfriend cannot be left unsupervised with your son. Consider a request for custody if your ex will not cooperate in limiting the boyfriends contact with the child.
