Taking Spouse of Medical Ins.

I am in process of completing disclosure statements to try and do a mediation for settlement before filing for divorce. My husband is on my policy (along with son), however, I am paying the premium out of my paycheck $300 for the family. My husband does not give me money for this expense. Can I take him off since I have open enrollment right now, (not legally separated, but have filed separate 2006 taxes, we sleep separately. Could I be sued if my husband had some medical emergency (or since I'm in the process of filing, would I be excluded from outstanding medical bills to a creditor?

You need to get a stipulation or court order before you can take him off your insurance policy.
