I'd like to know what step I need to take in order to grant my parents physical custody in the unlikely event of my death (and not my ex-husband.) Is there a court order I can apply for? What will make my last will for child custody legally binding?

There is nothing you can do. Children are not property you can will to whomever you want. Unless the father voluntarily gives up custody, or he is found legally unfit to parent his child in a child dependency hearing, he gets custody, period.
