teenage emancipation
My niece who is 16yrs of age wants to emancipate herself from her fathers custody. But she is concerned that her truancy record might affect the courts rulling other than keeping employment and being enrolled in school what other steps might help her win emancipation from her father? Also her father has used her ssn to get loans that he has not paid/and in turn has ruined her credit record could this fact help her argument for emacipation from her father.

If she has evidence that her father committed credit fruad, she may not have to be emancipated to become free from his control. Credit fraud is a crime and can result in a sentence to prison. It would also be grounds for the appointment of a guardian to protect her person and estate. If she is emancipated her parents no longer have a duty to provide support for her. If a guardian was appointed her parents would still have a duty to support her until she is 18. She should discuss the matter with a school counselor or other such person.
