Legal Question in Family Law in California

Dear Sir or Madam,

I recently separated from my husband and am now filing for a divorce through my local legal aid clinic as I have no money. When I moved I took my phone number with me, the telephone bill was in my name. When I received my bill it totalled over $400.00. When I viewed it I saw that during the time just prior to moving away from my husband he had placed calls to England and Mexico using the operator to place the calls. I don't have long distance on my phone just basic as I can't afford anything more than just a line so I can make local calls etc. He did this out of pure badness knowing the bill was in my name and believing I would be stuck with the bill. I made the payment using his bank details as he refused to pay the bill. Now he is claiming I am going to go to jail for fraud and I am really concerned about this. People are saying that because we are still married his debts are mine and mine are his. And the fact the bill incurred when we were still residing together people are saying I have broken no laws. Can you please reasure me that this is indeed the case as I am not too sure. Sincerely,--name removed--E--name removed--

As a general rule law enforcement does not get involved in domestic disputes over money or property. You should contact an attorney to review the facts of your case and take the appropriate steps to protect yourself from further debt and to protect the assets that you and your husband have accumulated.
