Legal Question in Family Law in California

Temporary Caregivers Agreement

Children were abandoned by mother while kids went to school, that day, stepdad calls to grandma and asks to care for 2 oldest kids; 2 younger kids are from stepdads marriage and he has them. Agreement with mom was that as soon she gets her life 2gether, come pick up her kids from us and we will discontinue being caregivers. Now 8 months later, mother is not willing to take over kids, moved out of state and says we are responsible for raising her kids since we all signed form. We dated agreement to end till kids turn 18 (now 14, 15) since we and mom did not know where she would be living (moves alot) and we did not want to chase her when the agreement date ended in case it was middle of a school year or if medical problems arose with kids. How legally binding is this form when mother and grandparents signed and was notarized, never thru the court? Can we get out of this form?

Re: Temporary Caregivers Agreement

The agreement probably has no legal binding effect whatsoever. A parent is legally obligated to support a child until the child is 18 and no longer in high school. Your options include: 1. Becoming a court ordered guardian whereby you would be entitled to Child support and County Assistance, 2. turning the children over to Child Protective Services where the children would be put into foster care.
