Legal Question in Family Law in California

Temporary Custody

I have a daughter who gave me temporary custody of her 17 month old daughter (my grandchild). I have had her for onver 2 1/2 month now. My daughter got the TC form from the count jail. She signed it and had a notary public sign it. The babies dad is in jail also, and now I have the other grand parents filing for temporary custody in San Jose, Ca. My daughter and I live in Stockton, Ca. Now my question is does the paper (form) my daughter gave me stand for anything? It does not have the CA stamp but it is sign by a Notary.

Re: Temporary Custody

You should consult with an attorney. There many factors that will need to be reviewed to determine the options that are available to you. As Mr. Chau stated the fact that the child has been with you will be helpful. But you must act quickly.

Re: Temporary Custody

If there is a custody dispute you should seek an attorney. The fact that you have had the daughter for a longer period of time will be in your favor.

Good luck.

As always consult a qualified attorney in your area before proceeding.
