Temporary Custody

i'll try to keep it short and to the point. Thank you for taking your time to read my question.

WHO: Ex-girlfriend, mother of minor child(2yrs.old)

2yr.old -my bio

4yr.old -i've raised since he was 8mo. old

mom's been evicted again for not paying rent for the last 6 months. instead drugs and tweeker friends more important.

mom got stabbed by new parolee boyfriend. shes been in the hospital for a week now. never contacted me or any immediate family member. so kids been hotel motel bouncin' for lord knows how long. i called at hospital, inquiring on the boys. she wouldn't tell me the hotel room #.. so i went knocking on every door at that roach coach motel, till i found them. Found them in a smoky room with their 12 yr.old half-sister and i'd say about 1/2 dozen guys . i've had the kids now for 2weeks now. Their mom has call once to check on the kids or just to say hi to them.. I filed for temporary custody. it was denied due to 'Containing Application'. I don't know the where abouts of the mother, in order to have her give me written consent to the 4 yr.old so that i can enroll him in pre-school and day care . How can i go about obtaing consent? i need it a.s.a.p.

Re: Temporary Custody

You should file a petition for guradianship, and request that you are appointed the temporary emergency guardianship of the children. Explain to the court that she is moving from place to place and is difficult to locate. Then request an order shortening time to serve her. This process has numerous requirements that must be strictly complied with.
