Temporary Spousal Alimony
i had been married to my ex wife for 18 years and was divorced in November 1999. i agreed to a temporary spousal support of $500 per month in December 1999 during our divorce on the grounds that my ex-wife had agreed to actively seek employment. i had no children with my ex-wife.
The fact that I have remarried to another person in August 2001 and I am not able to meet my financial obligations with the alimony. Can I request my attorney to waive the alimony agreed between my ex since she has not complied to her agreement after our divorce. She is healthy and fit to actively seek employment but she has not done so until recently, she now gets a part time job.
My divorce case for settlement is now coming for hearing this December 17. The case had been postponed twice as she was not present in Court last September and October for the hearing.
Will my case be settled at this hearing on 17 December and will my alimony be waived as I unable to live within my means at this moment?
Your advice on the matter would be much appreciated.

if the support has been made into a court order you need to file an OSC re modification to change or stop the support.
