Legal Question in Family Law in California

Termainating Guardianship

I am the guardian of a child who did not know his father until recently. They now have a wonderful relationship and the father would like the chance to be just that ''a father''. The child mother has supervised visits. If I were to terminate the guardianship how can I be sure the father will be able to keep the child and the mother continue with the supervised visits. It has been determined by the court that the child needs a guardian to protect him from his mother. If I were to stay as guardian can the child reside with the father?

Re: Termainating Guardianship

The court would have to make an order rescinding the guardianship. As a part of that process the court should make as a part of that order the placement of the child with the father. You should probably move slowly to make sure that the father is indeed prepared and able to take on the responsibilities of a parent.
