How do I terminate Child Support?

My son is soon to be 18, and will graduate from HS son after. He lives with his maternal grandparents & there is NO communication. I have not seen him in almost 2 years. How do I go about terminating the Wage Assignment once he has turned 18 and graduated from HS. His guardians will not cooperate in anyway.

File a motion with the court and request an order that child support terminate upon on the last day of school in June, or the date he should graduate from high school. This would terminate child support after the June payment. This order (a certified copy) could be served on both your employer and the district attorney's office.

NOW, IN RESPONSE TO YOUR INQUIRY --

Read the judgment or child support order. Unless it states otherwise the obligation to pay child support continues until the child marries, dies, is emancipated, reaches age 19, or reaches age 18 years and is not a full-time high school student residing with a parent, whichever occurs first, and then terminates by operation of law. If you have a wage assignment order against you and your employer is withholding money, you may need court action (stipulation and/or court order) to have the wage assignment order permanently stayed and the withholding stopped.
