Terminating guardianship when son turns 18

My brother received a settlement for a peronal injury case when he was 11 years old. The settlement monies were placed in a bank account for him, and my mother was appointed as his guardian ad litem. The court order stated that he would have access to his money once he turned 18 years of age. He just recently turned 18 and now he wants to use his money for college. What does he need to do so that the bank will give him access to his money? He has been told by bank officials that since his account was opened through a court order, that he needs a court order to now gain access to it. Please e-mail me with a response as to what are the steps necessary to obtain a court order for this situation. Does a petition have to be filed with the court? and what type of petition is it? thank you.

The process is called a Minor's Compromise. The process isn't a big deal, but you have to do it correctly, using the correct forms. Your brother may be able to get help at Legal Aid.
